Terms of service

These terms apply when you use OurForms. Text in [square brackets] needs filling in before this page goes live.

The agreement

These terms are between you (or the organisation you sign up for) and [Company legal name], [registered address] ("OurForms", "we"). By creating a workspace or using OurForms, you agree to them. If you sign up for an organisation, you confirm you can accept these terms for it.

Your workspace

• You're responsible for your workspace, the people you invite, and what they do in it.
• Keep your sign-in details safe, and tell us at [support email] if you think someone else is using your account.
• What you put into OurForms, and the answers your forms collect, stay yours. You give us permission to store and process them only to run OurForms for you.
• You're responsible for having a lawful basis to collect what your forms ask for, and for telling people how you use their answers. Our Privacy policy covers how we handle data.

Acceptable use

Don't use OurForms to:

• collect passwords, card numbers or other credentials by pretending to be someone else;
• send spam, malware or anything unlawful, or collect data you're not allowed to collect;
• harass people or publish content that's hateful or exploits anyone;
• attack, overload or probe OurForms, or get around its limits.

We may remove content or pause a form that breaks these rules, and suspend a workspace for serious or repeated breaches.

Plans and billing

• The Free plan is free. Paid plans are billed monthly or yearly in advance through Stripe, and paid plans can start with a free trial.
• Changing plan or billing cycle takes effect when the payment goes through. Moving to another cycle starts a new billing period that day, with credit for the unused part of the old one; moving within the same cycle adds the prorated difference to your next invoice.
• Moving to Free cancels your subscription at the end of the period you've paid for. We don't refund partial periods, except where the law requires it.
• Each plan has limits, such as responses per month, seats and file storage. When a limit is reached, the affected forms stop accepting new responses or files until the next month, or until you upgrade or make room.
• If a payment fails, we'll ask you to update your card; if it stays unpaid, your workspace may move to Free.
• Prices may change. We'll tell you at least [30] days before a change applies to you.

Availability

We work to keep OurForms running and show its current state on our Status page, but we can't promise it will always be available or free of errors. We may change or remove features; we'll give notice before removing anything you rely on.

Ending

You can stop using OurForms and close your workspace at any time. We may end or suspend your access if you break these terms or don't pay. Export anything you want to keep first; after closing, we delete workspace data as described in the Privacy policy.

Liability

OurForms is provided "as is". As far as the law allows, we aren't liable for indirect or consequential losses, and our total liability is limited to what you paid us in the 12 months before the claim. Nothing in these terms limits liability that can't be limited by law.

General

These terms are governed by the laws of [jurisdiction], and its courts decide any dispute. If part of these terms can't be enforced, the rest still applies. We'll update the date at the top of this page when the terms change, and tell workspace owners about significant changes in advance.
